Well, think again. Now that we have familiarized ourselves with the concept of <a href=\"https:\/\/malekavocat.com\/en\/important-new-legal-obligations-for-quebec-businesses\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"ultimate beneficiaries (opens in a new tab)\">ultimate beneficiaries<\/a>, the REQ is introducing a new requirement.<\/p>\n\n\n\n<p>As of June 1, 2023, <strong>new businesses<\/strong> and those <strong>already registered<\/strong> with 5 to 49 employees will have the obligation to declare the proportion of them who are not able to communicate in French.<\/p>\n\n\n\n<p>New businesses must declare this information in their registration\nor initial declaration. Businesses already registered must declare it in their\nannual declaration or by filing an updating declaration.<\/p>\n\n\n\n<p><strong>What does it mean to be able to communicate in French?<\/strong><\/p>\n\n\n\n<p>Being able to communicate in French at work means having the\nability to perform your tasks in French. Depending on the job category of an\nemployee and the tasks assigned to them, this ability can be assessed in the\ncontext of verbal or written exchanges with their colleagues, superiors or\ncustomers. Communicating in French implies, for example, having the ability to\nunderstand work instructions, attend meetings, follow training, write or share\nwork documents (memos, reports, forms, etc.) and serve customers in French.<\/p>\n\n\n\n<p><strong>Which businesses are covered by this declaration?<\/strong><\/p>\n\n\n\n<p>As of June 1, 2023, businesses already registered and new\nbusinesses that have 5 to 49 employees will have to declare the proportion of\ntheir employees who are not able to communicate in French.<\/p>\n\n\n\n<p><strong>How should I declare this information if the range of employees declared in the register does not correspond to the range of employees covered by the obligation?<\/strong><\/p>\n\n\n\n<p>If the range of employees declared in the register is\n&#8220;From 1 to 5&#8221;, the business will have to declare the proportion of\nemployees who are not able to communicate in French if it has 5 employees. This\nprocess will not be necessary for a business with 1 to 4 employees.<\/p>\n\n\n\n<p><strong>How often should I update the information?<\/strong><\/p>\n\n\n\n<p>If there is a change in the business, you must update the\ninformation declared at the REQ within 30 days following the date of this\nchange, by producing either<\/p>\n\n\n\n<p>&#8211; an annual declaration, if the production period is in\nprogress; or<\/p>\n\n\n\n<p>&#8211; an updating declaration.<\/p>\n\n\n\n<p><strong>Is this information public?<\/strong><\/p>\n\n\n\n<p>Yes.
